LOHR Website Terms & Conditions

These Website Terms & Conditions (“Terms”) apply to your access to and use of the LOHR website (“Website”) and the purchase of products from LOHR Jewellery Pty Ltd (“LOHR”, “we”, “us” or “our”).
By accessing our Website, booking a consultation, subscribing to communications or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.
1. Definitions
In these Terms:
ACL means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Product means any jewellery item sold by LOHR, including ready-to-wear, semi-custom or bespoke jewellery.
Order means an order placed via the Website, consultation or otherwise with us.
Website Content means all text, images, graphics, video, design, branding and material on the Website.
2. Use of the Website
You agree you will not:

use the Website for unlawful purposes;

interfere with or attempt to compromise Website security;
-
reproduce, copy, scrape or commercially exploit Website Content without written permission;
-
upload malicious software or harmful code.
We may suspend or restrict access where misuse is reasonably suspected.
3. Product Information
We take reasonable care to ensure descriptions, measurements, imagery and pricing are accurate. However:

images are illustrative only;
-
colours may vary depending on screen display;
-
measurements and carat weights may vary within normal manufacturing tolerances;
-
jewellery scale shown on hand images may not represent actual appearance when worn.
We may update or discontinue products without notice.
4. Pricing and Payment
All prices are displayed in AUD and include GST where applicable.
Payments are processed through third-party payment providers. LOHR does not store full credit card details.
We reserve the right to cancel orders where we reasonably suspect fraud or pricing errors. If an error occurs, we will refund any payment made or contact you before proceeding.
5. Orders and Acceptance
An order confirmation email acknowledges receipt only and does not constitute acceptance.
An order is accepted when we:

dispatch the product; or
-
confirm acceptance in writing.
We may decline or cancel an order where:
-
a product is unavailable;
-
payment cannot be verified;
-
a listing or pricing error occurred;
-
fraud is suspected.
6. Shipping and Delivery
We deliver to the address provided by you. You are responsible for ensuring the address is correct.
Delivery timeframes are estimates only and may be affected by circumstances outside our control.
Risk passes to you upon delivery. Title passes once full payment is received.
We will reasonably assist with courier investigations but are not responsible for delays caused by shipping providers.
7. Semi-Custom and Bespoke Jewellery
LOHR offers both semi-custom engagement rings and fully bespoke jewellery.
7.1 Semi-Custom Engagement Rings
Our classic engagement ring collection allows limited customisation, including:

metal type or colour
-
ring size
-
selected stone size (where offered)
These items are made to order specifically for you.
Because they are made to your specifications, semi-custom engagement rings are not eligible for change-of-mind returns once production has commenced, except where required under the ACL.
You are responsible for confirming the ring size selected. We can provide guidance but cannot guarantee accuracy.
7.2 Fully Bespoke Jewellery
Bespoke jewellery includes:
-
custom designed engagement rings
-
modified LOHR designs beyond listed options
-
altered settings, proportions or structure
-
customised jewellery pieces or private commissions
A quote and deposit may be required before production.
Design sketches, CAD renders and concepts remain LOHR intellectual property unless agreed otherwise in writing.
Bespoke jewellery cannot be cancelled or refunded after production has commenced except where required under the ACL.
7.3 Design Approval
Where design renders or stone selections are provided, you must review and approve all details carefully.
Your approval confirms acceptance of the design specifications. Once approved and production has begun, further changes may not be possible or may incur additional costs and delays.
7.4 Stone Characteristics
Every diamond and gemstone is unique. Variations in appearance, proportions and light performance may occur compared with images or renders.
CAD renders and try-on samples are indicative only and may not reflect exact real-world scale.
7.5 Production Timeframes
Production timeframes are estimates and may vary due to stone sourcing, manufacturing processes or supplier delays. Delays beyond our control do not entitle cancellation or refund.
7.6 Resizing
On eligible engagement rings, LOHR offers one complimentary resize within 12 months of delivery, provided the ring is in original condition, the design allows safe resizing, and the size adjustment is within a reasonable range. The following limitations apply:

not all designs can be resized (e.g. full diamond bands and certain pavé settings);

large adjustments may affect structure or appearance;
-
further or significant resizing beyond the first complimentary one, and resizes after 12 months from delivery, may incur a fee plus shipping costs.
We may decline resizing where it risks damage. Refer to the Returns & Aftercare Policy and Warranty & Care Policy for full details.
7.7 Wear and Care
Fine jewellery is delicate. Normal wear may include scratches, metal softening and claw movement.
LOHR is not responsible for damage caused by impact, improper care, third-party repair or accidental loss of stones.
We recommend periodic servicing and jewellery insurance after delivery.
8. Returns and Australian Consumer Law
Our Returns Policy forms part of these Terms.
Nothing in these Terms excludes your rights under the ACL. You may be entitled to a repair, replacement or refund if a product:
-
is faulty;
-
is not as described; or
-
fails to meet consumer guarantees.
Change-of-mind returns may be offered for eligible ready-to-wear items only where stated in our Returns Policy.
Bespoke and made-to-order items are not eligible for change-of-mind returns.
9. Intellectual Property
All website content, designs, branding, product designs and imagery are owned or licensed by LOHR.
You must not reproduce, distribute or use any LOHR intellectual property without prior written permission.
10. Reviews and User Content
If you submit reviews, photographs or social media content to LOHR, you grant us a non-exclusive, royalty-free, worldwide licence to use that content for marketing and promotional purposes, unless you request removal and we can reasonably comply.
11. Third-Party Links
The website may contain links to third-party sites. We are not responsible for third-party content, services or privacy practices.
12. Limitation of Liability
To the maximum extent permitted by law, LOHR is not liable for indirect or consequential loss.
Where liability cannot be excluded under the ACL, our liability is limited to:

repair,
-
replacement, or
-
refund of the product (at our discretion).
13. Privacy
Your use of the Website is governed by our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. The current version published on the Website applies at the time of purchase or use.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
